Can a lessor tell a lessee they can’t rebuild a boat dock that was damaged by storm?

We have a fishing camp in Louisiana on long term lease of land. The existing dock was destroyed in storm and what was left was unsafe to repair. If we build another dock right on top of the existing (broken) dock, can the land owner prevent us from rebuilding it? All we have on the lease is surface rights/usufruct.


Technically they can tell you this. The best way to handle this situation is to contact the leasor first and tell them of the unsafe condition of the dock. Then either they HAVE to fix it or they’ll let you fix it yourself. I don’t see why they’d have a problem with you fixing it, though.

Special hardware or techniques may be required, so follow the manufacturers instructions for installing flotation in your dock framing.
