I GOT WITH MY HUBBY ABOUT 6YRS AGO. HE HAD JUST BEEN DISCHARGED FROM THE USMC IN MIRAMAR CALI.(BAD CONDUCT) SEE WHAT HAPPENED IS HE WAS A MP IN CAMP FOSTER JAPAN AND HE LOVED IT BUT IT WAS SHORT LIVED THEY SENT HIM BACK TO THE STATES TO MIRAMAR. HE SAID IT WAS HORRIBLE HE HATED IT HE HAD NO ONE..NO FRIENDS,NO FAMILY HE GOT DEPRESSED AND LEFT WITHOUT PREMISSION (AWOL) WELL HIS FATHER BEIND RETIRED AIRFORCE..FOUND OUT ABOUT IT AND WENT AND TRICKED MY HUBBY TOOK HIM TO AN HOTEL AND CALLED THE USMC TO PICK HIM UP WHILE HE WAS SLEEPING.WELL HE WAS COURT MARTIALED HE SPENT 6 MONTHS IN THE BRIGG PAID ALL HIS FINES THEY TOLD HIM “YOUR GOOD TO GO” SO HE GOT OUT AND LEFT THE NEXT DAY CAME BACK HOME TO ALABAMA AND NEVER LOOKED BACK. SINCE THEN WE MET GOT MARRIED AND HAVE TWO VERY SMALL GIRLS A 2YR OLD AND 8MONTHS OLD. ONEDAY ABOUT 3WEEKS AGO THE COP RAN MY HUSBANDS NAME AND HE CAME BACK A DESERTER FROM THE MARINE CORPS, THEY TOLD THE OFFICER TO BRING HIM IN.TWO DAYS LATER THE USMC SENT MP’S TO TAKE HIM TO CAMP LEJUENE N.C WHERE HE IS BEING HELD NOW. WE HAVE SPOKEN TO HIS LAWYER AND HE INFORMED US THAT HE HAD BEEN DISCHARGED ALL THOSE YEARS AGO AND THAT BASICLLY THEY ARE HOLDING A CIVILIAN ON A MILITARY BASE. WHICH IS ILLEGAL. BUT THEY HAVEN’T RELEASED HIM….WHY? DOES HE HAVE TO GO TO TRIAL? HE SHOULDN’T! HE’S ALREADY DONE HIS TIME AND PAID HIS FINES! I DON’T KNOW WHAT TO DO I HAVE 2 SMALL BABIES NO ONE TO WATCH THEM WHILE I WORK I CAN’T AFFORD DAYCARE I HAD TO LET THEM STAY WITH MY MOTHER IN LAW 300MILES AWAY SO I CAN PACK UP OUR HOUSE AND MOVE IT INTO STORAGE BECAUSE I CAN’T PAY FOR IT WITHIN A 48HR PERIOD I LOST MY HUSBAND, MY KIDS,MYHOUSE AND MY JOB!!! PLEASE SOMEBODY TELL ME WHATS GOING ON!! I JUST WANT MY FAMILY AND MY LIFE BACK!!! WHATS GOING TO HAPPEN?

military courts are way different the civilian courts. they can do what ever they want. dont be surprised if they want him to do his time in service and send him to iraq.

If he has his DD214 then it shouldn’t be an issue (if he really was discharged he would have this) It sounds like you don’t have the full story. You said he went AWOL are you sure he went back and was properly discharged? The MP’s wouldn’t have come all the way to get him if he wasn’t wanted by them for being AWOL.
This is your husbands fault not the Military. They didn’t tell him, force him or allow him to be a deserter. He made that choice all by himself.

You’re either completely clueless about his past and totally in the dark about what is happening or you’re full of crap and think we’re all stupid enough to fall for it.
Why don’t you call where he’s being held and ask the charges and when he is to be released. Something other than what is written must be going on.

There is no way he would have misplaced it, its too important. You nedd to look for it. His dad would know this also. There must be things you don’t know about. Your life must have had some secrets.

If you have any paperwork that was given to him when he was released from the 6 month imprisonment, that should be sufficient to get him released.
But if not, and as you say, if he’s in the clear, that fact should come to light as soon as they try to confirm that he’s a “wanted subject”.
If all that fails, then things may become a little more complicated – you will probably need to get a lawyer. If you can’t afford a lawyer, you might be able to find one who will work “pro bono” – check with a church, or other charitable organization – they might be able to offer some advice.
you are assuming he told you the truth. somebody that would desert like that would probably have no inhibition against lying.
Listen, there are so many holes in this I don’t know where to begin…you either aren’t purposely posting ALL the facts or you just don’t know them. This ‘trickery’ by his father, the awol and couts-martial, discharge being ‘go to good’, a cop just happening to just otta of the blue running your husband’s name (you fail say what he did to get the cop’s attention), the civilian authories ‘bringing’ him in and MPs taking him in (this reeks of him being still on lamb from before and you not knowing or not caring because you had to know), you not saying what his DD214 says…..
This is grade-A criminal act stuff and he did something he is still wanted for! It could be a crime such murder, child porn, drug selling, rape, larceny, or a war crime (where there is no statute of limitations) etc. The military could have been lookin for him for a while due to him being implicated in more crimes. Something way more serious than a lousy AWOL or even a desertion.
I know because I deal with this daily….so please get the facts (and make sure you are posting everything not that we can help here) and get a lawyer ASAP! This is when your family and friends need to help you guys out and see you though this.

The chronology does not make sense. If he received a bad conduct discharge because of his being convicted in a Special or General Court Martial in the Marine Corps, the last thing any Marine would have said to him is “you are good to go”. And if he received a Bad Conduct Discharge many years ago at MCAS Miramar, he would certainly know it.
So, it appear he did get court-martialed, did some brig time, but didn’t get discharged. Instead he deserted. Now he has been caught. None of that is the fault of the Marine Corps or the Department of Defense. You appear to have been lied to. Big time.
Get a lawyer and bear this in mind. Every 1st and 15th of the month the Marine Corp gave him everything. Your husband is fully to blame here because he mades some bad decisions to have affected you. What most say here is tre if he in fact received a proper discharge his personnell record (which he should have a copy of) should state that.
The truth will play out here soon enough. Also you might ask if since he is in custody if he is considered on active duty and drawing pay.
